Process for Unsolicited Submissions
Allison Baver Entertainment has a stated interest in receiving proposals that contain new ideas and innovative concepts pertaining to ABE mission, growth and production initiatives. Allison Baver Entertainment (ABE) will consider an unsolicited submissions, providing the submission follows certain rules, see Process for Unsolicited Submission Rules.
What Constitutes an Unsolicited Proposal?
An "unsolicited proposal," is a written proposal for a new or innovative idea that is submitted to ABE the initiative of the offering company (i.e. your company) for the purpose of obtaining a contract with ABE, and that is not in response to an RFP, broad announcement, or any other ABE initiated solicitation or program. For an unsolicited proposal to comply with our rules, it must be:
Innovative and unique
Independently originated and developed by the offering company
Prepared without ABE supervision, endorsement, direction or direct ABE involvement
Detailed enough to show that ABE support could be worthwhile, and that the proposed
work could benefit ABE mission and growth.
Not an advance ABE proposal for a production that you know ABE will need and that
could be acquired by competitive methods
Not address a previously published production.

Preparing to Submit an Unsolicited Proposal
In order to allow ABE enough time to evaluate your proposal and negotiate a contract, an unsolicited proposal should be submitted well in advance of your company's desired starting date for ABEs contract. Before preparing a detailed unsolicited proposal, make some initial inquiries as to whether there's a need for the contract you're proposing to media@allisonbaver.com. This will help you better understand ABEs interest as they relate to your project.
There's no guarantee of funding for the unsolicited proposal. During your inquiry, which must be made by email only, be on the lookout for any specific requests that may arise, including signature of an NDA or additional supporting materials.
Preliminary discussions often reveal information that may help you change your proposal to more closely match ABEs requirements. Based on the preliminary survey, go forward with the unsolicited proposal if you determine that it's of merit and has relevance to ABEs needs and that, if sponsored, such merit can be demonstrated.
Submitting an Unsolicited Proposal
An unsolicited proposal must include the following basic information:
Your name, address and type of talent or organization (writer, producer, production
company, actor etc.).
Names and telephone numbers of personnel to be contacted for evaluation or
negotiation purposes.
Identification of any proprietary data to be used only for evaluation purposes.
Formal and informal attachments to the project, along with signed contracts.
Chain of Title information for all relevant materials including the name and contact
information of all previous and existing owners.
Names of other parties receiving the unsolicited proposal or funding the proposed
effort.
Date of submission and your signature, or the signature of another person authorized
to represent and contractually obligate.
The following technical information should be included in an unsolicited proposal:
A short title and abstract (approximately 200 words) of the proposed service or
product.
A complete discussion stating the objectives of the product, the method of approach
and extent of effort to be employed, the anticipated results, and how the work will help
to accomplish ABEs mission.
Names and biographies of key personnel who would be involved, including alternates.
Type of support needed from ABE
An unsolicited proposal should also include the following supporting information:
Full Script or Formal
Proposed price or total estimated cost, in sufficient detail for meaningful evaluation
including project budget.
Period of time for which the proposal is valid.
Type of contract preferred.
Proposed duration of the service.
Concise description of the person or organization, previous experience, relevant past
performance, and facilities to be used in the proposed activity.
Other statements, if applicable, about organizational conflicts or interest, intellectual
property clearances, and impacts.
The names and telephone numbers of contact persons already spoken to regarding
the unsolicited proposal.
If your proposal includes any proprietary information, be sure to mark the proposal
with the restrictive legend and be aware that ABE is not responsible for any unsliced submissions without a formal signed contract and NDA.
What Happens Once You Submit an Unsolicited Proposal
ABE will acknowledge receipt of unsolicited proposals as soon as is practical. If the proposal cannot be properly evaluated within 90 working days, you will be forwarded an interim reply including the evaluation's estimated completion date. Upon completion of the evaluation, your company will be notified of the results.
Unsolicited proposals will be evaluated by appropriate personnel. If the evaluators request further information, providing it will be at your company's own expense and risk, and a request for more information does not necessarily mean ABE has made any final decisions. Your unsolicited proposal could be disqualified if it is any of the following:
Merely a normal development or extension of an existing production, or for a specific
ABE requirement which would normally be decided by standard competition.
Designated an "unsolicited proposal" for the apparent purpose of avoiding
competition.
Based on information already in the public domain, or on information to which your
company has no exclusive right, either as a matter of law or of ethical business
practice.
Under circumstances that create a question as to your company's exclusive right to
consideration for the project.
Submitted in response to a request from higher-level ABE personnel for proposals
from others on a given topic.
An alternate proposal submitted because of any solicitation issued by ABE.
In the event the unsolicited proposal is not accepted, ABE is not obligated in any way
to reimburse your company for any costs incurred.
Unsolicited Proposals and ABE
ABE advises any potential talent offering unsolicited proposals that only Owner and CEO, Allison Baver, can enter ABE into a binding contract. The personnel who receive, handle, or evaluate unsolicited ABE proposals are not authorized to make any commitments on ABEs behalf. ABE will commence negotiation only when the following apply:
An unsolicited proposal has received a favorable comprehensive evaluation
The unsolicited proposal is not of the character described in the above list
ABE determines a substantial talent role is available for Allison Baver when
applicable.
ABE supports the project, assessing competition, and necessary funding
ABE has complied with executed any justification and obtained any approval or
determination and findings that are required under ABE Unsolicited Submission Rules.
ABE Unsolicited Proposals Rules
(a) Unsolicited proposals allow unique and innovative ideas for content that have been developed outside ABE be made available to ABE for use, purchase or partnership. Unsolicited proposals are offered with the intent that ABE will enter into a
contract with the offeror for funding, development, production, distribution, talent, or efforts supporting ABE’s mission, and often represent a substantial investment of time and effort by the offeror.
(b) Advertising material, commercial item offers, or contributions, as defined in definitions, or routine correspondence on business operations, are not unsolicited proposals.
(c) A valid unsolicited proposal must-
(1) Be innovative and unique;
(2) Be independently originated and developed by the offeror;
(3) Be prepared without ABE supervision, endorsement, direction, or direct
ABE involvement;
(4) Include sufficient detail to permit a determination that ABE support could
be worthwhile and the proposed work could benefit ABEs mission and growth;
(5) Not be an advance proposal for a known production that can be acquired
by competitive methods; and
(6) Not address a previously published production.
(d) Unsolicited proposals in response to a publicized general statement of ABE’s needs are considered to be independently originated.
(e) ABE must evaluate unsolicited proposals for performance potential in accordance with ABE valuation procedures.
ABE Unsolicited Proposals Definitions
As used in this subpart-
Advertising material means material designed to acquaint ABE with a prospective
contractor’s present products, services, or potential capabilities, or designed to stimulate ABE’s interest in buying such products or services.
Commercial item offer means an offer of a commercial item that the vendor wishes to see introduced to ABE. This term does not include innovative or unique configurations or uses of commercial items that are being offered for further development and that may be submitted as an unsolicited proposal.
Contribution means a concept, suggestion, or idea presented to ABE for its use with no indication that the source intends to devote any further effort to it on ABEs behalf.
Limited Use of Data
An unsolicited proposal may include data that the offeror does not want disclosed to the public for any purpose or used by ABE except for evaluation purposes. If the offeror wishes to restrict the data an NDA must be signed by both companies and your submission must be marked with a a legend noting the specific data you do not want disclosed.
Use and Disclosure of Data
This proposal includes data that shall not be disclosed outside of ABE and shall not be duplicated, used, or disclosed-in whole or in part-for any purpose other than to evaluate this proposal. However, if a contract is awarded to this offeror as a result of-or in connection with-the submission of these data, ABE shall have the right to duplicate,
use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit ABE’s right to use information contained in these data if they are obtained from another source without restriction. The offeror understands that ABE may already have another similar or adjacent proposal or project and indemnifies ABE for any loss resulting from this risk.
Unsolicited Proposal-Use of Data Limited
All ABE personnel must exercise extreme care to ensure that the information in this proposal is not disclosed to an individual who has not been authorized access to such data, and is not duplicated, used, or disclosed in whole or in part for any purpose other than evaluation of the proposal, without the written permission of the offeror. If ABE engages the proposal, terms of the contract shall control disclosure and use. This notice does not limit ABE right to use information contained in the proposal if it is obtainable from another source without restriction. This is a ABE notice, and shall not by itself be construed to impose any liability upon ABE or ABE personnel for disclosure or use of data contained in this proposal.
(a) An offeror should identify trade secrets, commercial or financial information, and privileged or confidential information to ABE.
(b) When ABE receives an unsolicited proposal without any restrictive legend, ABE may -
(1) Obtain a written agreement from the offerer evaluator before continuing with any further evaluation and can also obtain a written agreement from any parties necessary to continue the evaluation process.
Receipt and initial review
(a) Before initiating a comprehensive evaluation, the ABE contact point shall determine if the proposal-
(1) Is a valid unsolicited proposal, meeting the requirements set forth in the Process for Unsolicited Submissions
(2) Is suitable for submission in response to ABE requirements
(3) Is related to ABEs mission and growth;
(4) Contains sufficient information for evaluation;
(5) Has overall quality merit;
(6) Has a lead, supporting, voice, host and preferred talent/ producer role for Allison Baver.
(b) If the proposal meets these requirements, the contact point shall promptly acknowledge receipt and process the proposal.
(c) If a proposal is rejected because the proposal does not meet the requirements of paragraph (a) of this subsection, ABE may promptly inform the offeror of the reasons for rejection in writing and of the proposed disposition of the unsolicited proposal.
